Lake Charles Gun Crimes Attorney
Weapons Defense Built on Prosecutorial Experience at the 14th Judicial District Court
Facing a weapons charge in Lake Charles means your case can move through the 14th Judicial District Court in Calcasieu Parish, prosecuted by the same office where founding attorney James E. Sudduth III once worked. Before founding Sudduth & Associates, LLC in 2013, Sudduth served as an Assistant District Attorney in the Calcasieu Parish DA’s office, where he rose to Misdemeanor Section Chief. When offered a promotion into the Felony Division, he left to represent the accused instead. That background shapes how we read the state’s case against you, identify the arguments it’s likely to lean on, and find the vulnerabilities in its evidence.
We defend clients facing gun crimes, firearms charges, and weapons offenses throughout Lake Charles and Calcasieu Parish. Consultations are available in English and Spanish, and same-day and urgent appointments can be arranged.

Louisiana Open Carry & Permitless Concealed Carry
Louisiana became a permitless concealed carry state effective July 4, 2024, under La. R.S. 14:95(M). Any person 18 or older who can legally possess a firearm may now carry concealed without a permit. Open carry has also been permitted without a permit for persons 18 or older who are not otherwise prohibited from possession. Permitless carry doesn’t eliminate location-based restrictions, and it doesn’t remove the prohibitions that apply to disqualified persons. If you’re unfamiliar with where those lines fall, a firearms-related encounter with law enforcement can escalate quickly.
Can a Convicted Felon Possess a Firearm in Louisiana?
If you’ve been convicted of certain offenses, or are subject to certain court orders, your right to possess a firearm may be restricted or eliminated entirely. Under Louisiana law, any of the following can prohibit firearm possession:
- Weapons offenses
- Burglaries
- Crimes of violence
- Felony drug crimes
- Sex crimes
- A qualifying Domestic Abuse Protective Order
State law provides for potential restoration of firearm rights 10 years after completion of the full sentence, including probation and parole, depending on the offense. That 10-year period doesn’t automatically restore federal rights. Federal law under 18 U.S.C. 922(g)(1) operates independently, and a state restoration doesn’t lift a federal firearms disability. The full state-versus-federal distinction is addressed in detail in the sidebar.
The combination of firearms and narcotics compounds every risk. When a firearm is found in the presence of illegal drugs, law enforcement frequently treats the pairing as evidence of intent to distribute rather than simple possession. The sentencing exposure from stacked drug and weapons charges is categorically different from either charge standing alone.

"Keep fighting the Good Fight. I give my absolute highest recommendation!"Upon meeting with Mr. Sudduth for the first time, it was very obvious to me that he was well experienced in his areas of practice. He was very communicative, made himself available to address any concerns or needs and was extremely attentive to the details of my case. As thorough, goal-oriented, hard-working and determined as he and his staff were, one attribute stood out among the rest-they genuinely cared about me and my family. This was my first (and hopefully last) experience dealing with this type of litigation and the trauma it caused us, but James was there every step of the way and he fought for me; he fought for a resolution to the injustice I suffered. He cut straight through all of the nonsense and helped change workplace culture to make it a better place to work for everyone. For that, I am extremely grateful and proud that I made the choice to hire him as my attorney. I pray that many blessings come to the Sudduth and Associates team—Keep fighting the Good Fight. I give my absolute highest recommendation!- Rebecca
