Louisiana Firearms Laws Every Lake Charles Resident Should Understand

Louisiana’s firearms laws shifted significantly on July 4, 2024, when the state became a permitless carry state for concealed firearms. Under La. R.S. 14:95(M), any person 18 or older who can legally possess a firearm may now carry concealed without obtaining a permit. Open carry has long been allowed without a permit for those 18 or older who are not otherwise prohibited. Understanding where the law protects you and where it doesn’t is essential before any firearms-related encounter with law enforcement.

Prohibited Locations Under Louisiana’s Carry Laws

Permitless carry doesn’t mean unrestricted carry. Even those who can legally possess and carry a firearm are prohibited from doing so in a number of locations, including:

Schools and school buses
Courthouses and government meeting places
Polling places during elections
Detention facilities and jails
Bars and establishments holding on-premises alcohol permits
Places of worship, unless authorized by the governing body
Airports, beyond security checkpoints

Carrying in a prohibited location can result in criminal charges even for someone who would otherwise be fully legal to carry. A good-faith misunderstanding of where firearms are restricted doesn’t eliminate criminal exposure.

Felon-in-Possession: State & Federal Distinctions

Under Louisiana law, a person convicted of certain offenses including crimes of violence, felony drug crimes, sex crimes, burglary, weapons offenses, or a Domestic Abuse Protective Order may be prohibited from possessing a firearm. State law allows for potential restoration of firearm rights 10 years after completion of the full sentence, including probation and parole, depending on the nature of the offense.

Federal law under 18 U.S.C. 922(g)(1) operates independently. A state law restoration of rights doesn’t automatically lift a federal firearms disability. Federal charges can apply even where a person believes their state rights have been restored, and federal courts impose mandatory minimum sentences that state courts can’t. Anyone with a prior felony conviction who is considering firearm possession should consult counsel before acting on any assumption about restored rights.

The Louisiana Constitution at Article 1, Section 11 treats the right to bear arms as a fundamental right and subjects any restriction on it to strict scrutiny. That constitutional protection matters in both legislative challenges and individual defense strategies.

Defense Strategies in Weapons Crime Cases

Fourth Amendment Challenges

A successful Fourth Amendment challenge can remove the firearm from evidence entirely, which may lead to charge reduction or dismissal.

Constructive vs. Actual Possession

Actual possession means the firearm was found on the person. Constructive possession requires the prosecution to prove that the defendant had knowledge of the weapon and intended to exercise control over it. When a firearm is found in a shared vehicle or a residence with multiple occupants, constructive possession is frequently contested. The prosecution can’t simply point to proximity; it must establish knowing control.

Justifiable Use & Castle Doctrine

Louisiana is a Castle Doctrine state with a stand-your-ground statute. There is no duty to retreat in any place a person has the legal right to be before using force.
